Terms of Service

Section 1 (Application of Terms)
These Terms of Service ("Terms") apply to all relationships regarding the use of "QuizJam" ("the Service") provided by Takao Matsumoto (Trading as: CastGamingKit, hereinafter "the Company").
Section 2 (Service Description)
- This Service is an interactive quiz overlay tool for live streamers.
- This Service is an entertainment tool and does not provide prizes, rewards, redeemable points, or any other economic value to users.
- In-game "achievements," "scores," "results," and similar indicators are all visual effects and hold no economic value.
- Definitions:
- "AI Problem Usage" means using questions stored in the community database (including those previously generated by AI) for quizzes. No new AI requests occur.
- "AI Problem Generation" means having AI (Claude, OpenRouter, etc.) create new questions. An API request occurs each time.
- "1 Ticket" means the right to submit 1 question (including AI review and choice generation). Partial use (AI review only or submission only) is not possible.
Section 3 (Accounts)
- Some features of this Service require account registration.
- Users under 18 years of age must obtain parental or guardian consent before purchasing tickets or subscribing to the Standard or Pro plan.
- Payments made by minors without proper parental or guardian consent may be cancelled.
Section 4 (Tickets)
- "Listener Tickets" and "Streamer Generation Tickets" sold through this Service have the following properties:
- Valid for 180 days from the date of issue (the date of issue is defined as when the payment completion notification is received from the payment processor and recorded in our system)
- Usable only within this Service
- Non-transferable, non-exchangeable, and non-refundable
- Automatically invalidated after expiration; no refund is provided for unused portions
- Ticket purposes:
- Listener Tickets: Payment for AI review and database registration when submitting questions to streamers. Available in packages: Small ¥120/$0.99 (5 submissions), Medium ¥500/$3.99 (25 submissions), Large ¥980/$7.99 (50 submissions). 1 ticket = 1 AI review + 1 submission as one set.
- Streamer Generation Tickets: Payment for generating AI questions beyond the monthly limit
- These tickets qualify as prepaid payment instruments exempt from the Payment Services Act under Article 4, Paragraph 2 of the Act and Article 4, Paragraph 2 of its Enforcement Order.
- The Company shall obtain explicit consent from users regarding the contents of this section before ticket purchase.
Section 5 (Subscription Plans)
- The Service offers the following subscription plans for streamers:

- Cancellation is available until the day before the next renewal date. The Service continues until the end of the current billing period.
- No prorated refunds are provided.
Section 5-2 (Fair Use Policy)
- "Unlimited" usage in the Pro plan means a reasonable range of use for individual streamers.
- The Company may restrict usage in the following cases:
- Use of automated tools or bots to generate excessive requests
- Commercial resale or redistribution of quiz content
- Exceeding 1,000 questions per day
- Any activity that interferes with the normal operation of the Service
- When restrictions are applied, the Company will provide prior notice via email when possible.
- AI Problem Generation is subject to a separate monthly cap of 50 questions, regardless of "unlimited" usage designation.
Article 6 (Refunds and Cancellation)
- The Service constitutes "mail order sales" under the Act on Specified Commercial Transactions. Mail order sales are not subject to the cooling-off period under said Act.
- Tickets and subscription plans provided by the Service are consideration for digital services and are not subject to the statutory right of return under Article 15-3 of the Act on Specified Commercial Transactions.
- Due to the nature of digital services, cancellation and refund after payment completion are not accepted. Exceptions apply only in the following cases:
- When tickets or subscription rights were not properly granted due to system failure
- When the Company was unable to provide the Service due to reasons attributable to the Company
- This Article does not limit the user's right to cancel or terminate under the Consumer Contract Act or the Civil Code.
Section 7 (Prohibited Activities)
Users are prohibited from engaging in the following activities:
- Violating laws or public morals
- Infringing on the rights of other users or third parties
- Posting discriminatory, violent, obscene, or otherwise inappropriate content
- Harassment or defamation
- Unauthorized posting of personal information
- Inciting criminal activity or providing benefits to antisocial forces
- Reselling, transferring, or fraudulently obtaining tickets
- Using this Service for fund transfers, monetary transactions, or other unintended economic purposes
- Wagering money or goods on quiz results
- Offering prizes or rewards to quiz winners
- Using this Service as a lottery, sweepstakes, or gambling mechanism
Section 8 (Relationship with Streaming Platforms)
- This Service reads chat and Super Chat / Bits / Gift ("boost") information from YouTube, Twitch, TikTok, and Kick to reflect in game effects.
- The Company does not receive, mediate, or process viewer-to-streamer Super Chats or similar payments. These are transactions completed entirely within each streaming platform.
Section 9 (Content Moderation)
- The Company reserves the right to review, edit, or remove user-submitted quiz questions.
- AI-based content moderation may automatically flag or reject submissions that violate the Terms.
- Users who repeatedly submit inappropriate content may have their submission privileges restricted or their accounts suspended.
- Content moderation decisions are at the sole discretion of the Company and are not subject to appeal.
Article 10 (Intellectual Property and Content)
10.1 Company Content
- All intellectual property rights related to the Service (UI, design, logo, features, etc.) belong to the Company or its rightful owners.
- Users do not acquire any of these rights by using the Service.
10.2 User-Submitted Content
- Copyright of content submitted by users (including questions, keywords, and choices, collectively "User Content") belongs to the users.
- Users grant the Company a royalty-free, non-exclusive license to reproduce, adapt, publicly transmit, display, and distribute User Content to the extent necessary for the operation, improvement, and promotion of the Service. This license survives for a reasonable period after the Service ends.
- Users warrant that User Content does not infringe any third-party rights (copyright, trademark, portrait rights, privacy rights, etc.). Users shall indemnify the Company and compensate for any damages arising from such infringement.
10.3 AI-Generated Content
- The Service uses AI (Claude by Anthropic, OpenRouter, etc.) to generate and review questions.
- The Company does not guarantee the accuracy or legality of AI-generated content. Users utilize such content at their own responsibility.
- If AI-generated content contains factual errors, copyright infringement, or other issues, please report them via the reporting feature described in Article 9.
10.4 Moderation
- The Company may remove or unpublish content that violates these Terms, applicable laws, or public order and morals, without prior notice.
- The Company shall not be liable to users for removal or unpublishing due to moderation.
- If content is removed due to moderation, consumed tickets are returned to the original batch (expiration date is not extended).
10.5 Third-Party Takedown Requests
- Upon receiving notice of rights infringement from a third party, the Company may temporarily unpublish the relevant content.
- Takedown requests should be sent to support@castgamingkit.com. Please include proof of copyright ownership or agency, specific details of the infringement, and contact information.
- If a takedown request is found to be unjustified, the Company will restore the content.
Article 11 (Disclaimer)
- The Service is provided "as is".
- The Company shall not be liable for any damages incurred by users due to the interruption, suspension, or termination of the Service, except for damages caused by the Company's intentional misconduct or gross negligence.
- If any provision limiting the Company's liability under this Agreement is deemed invalid under the Consumer Contract Act or other applicable laws, the Company shall compensate users for damages caused by its slight negligence up to the amount of fees paid by the user to the Company during the most recent one month. This limit shall not apply to damages caused by the Company's intentional misconduct or gross negligence.
- The Company shall not be liable for damages arising from changes in specifications, failures, or service terminations of streaming platforms (YouTube, Twitch, TikTok, Kick, etc.) or for reasons not attributable to the Company.
- The Company does not guarantee the accuracy of AI-generated content.
Section 12 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
Article 13 (Changes to Terms)
- The Company may amend these Terms pursuant to Article 548-4 of the Civil Code.
- When amending these Terms, the Company shall notify users of:
- The content of the amended Terms
- The effective date of the amendment
- Notification method: posting on the Service dashboard, email to registered addresses, or publication on the website (castgamingkit.com)
- If a user does not withdraw from the Service by the effective date of the amendment, the user shall be deemed to have consented to the amended Terms.
- For material changes that are disadvantageous to users, the Company shall provide notification at least 30 days before the effective date.
